- Broker Comment: ON OR AROUND THE 6TH OF JANUARY 1983, I, JOHN SABATER WAS CHARGED BY THE MONTGOMERY POLICE DEPARTMENT IN THE STATE OF MARYLAND, FOR ASSAULT AND WEARING AND CARRYING A HANDGUN. THE INCIDENT STARTED AT A LOCAL RESTAURANT AND BAR. WHEN THE CASE WAS HEARD IN COURT, THE CHARGES WERE REDUCED TO GUN POSSESSION AND THE ASSAULT CHARGES WERE DROPPED. THE FINAL DISPOSITION FOR THIS CASE WAS A PBJ (PROBATION BEFORE JUDGMENT). HOWEVER, 2 MONTHS AFTER MY COURT APPEARANCE, I WAS PULLED OVER FOR DRIVING UNDER THE INFLUENCE OF ALCOHOL AND THE NEW CHARGE (DUI) VOIDED MY PREVIOUS DISPOSITION. I WAS NOW IN VIOLATION OF MY PROBATION WHICH MEANT THAT THE CHARGES WERE NOW A FELONY CHARGE. I WAS SUBSEQUENTLY PLACED ON SUPERVISED PROBATION FOR 24 MONTHS WHICH I SUCCESSFULLY COMPLETED AND SATISFIED. NO FURTHER CHARGES WERE FILED AGAINST ME AND I DID NOT HAVE TO DO ANY JAIL TIME. THE FELONY CHARGE STUCK AS A RESULT OF MY DUI FOR VIOLATING MY PROBATION. IT WAS SHOWING AS A FELONY ON MY RECORD BUT FOR SOME REASON MARYLAND IS NOW SHOWING THE OFFENSE AS A MISDEMEANOR.
